All images from Michigan.Photography are sold as high-resolution, royalty-free digital files. Upon purchase, you receive the full original file (no watermarks) and a license based on your selection.
“Royalty-Free” means the license fee is paid once — no ongoing royalties or additional fees are owed, regardless of frequency or duration of use, provided such use remains within the scope of the license granted below.
We retain full copyright ownership of all images. Licenses are perpetual, non-exclusive, and non-transferable, except as expressly permitted herein. By completing your purchase, you agree to these terms.
Commercial Use License
This license is for businesses, organizations, and professionals using the image to support commercial activities.
Permitted Uses:
- Advertising, marketing, and promotional materials
- Websites, social media, presentations, and digital campaigns
- Printed materials such as brochures, flyers, posters, and packaging
- Merchandise and products for sale, provided the image is not the primary value of the product unless expressly authorized
- Editorial use in books, magazines, or reports
Key Limitations:
- Print runs: Maximum of 500,000 physical copies in total across all printed materials
- Digital and web use: Unlimited and perpetual for the specific project, product, or campaign for which the image was licensed
- Project scope: Use is limited to a single brand, client, or campaign. Use in additional unrelated projects, brands, or campaigns requires a separate license purchase
- Agencies & client work: Agencies, designers, and marketers may use the image for a single end client project, provided the license is not transferred and the image is not reused for additional clients without purchasing additional licenses
- Extended rights (including unlimited print runs, multi-project use, or exclusivity) are available upon request with custom pricing

Personal Use License
This license is intended for individuals for non-commercial, personal enjoyment only.
Permitted Uses:
- Personal prints and home décor (unlimited non-commercial copies for your own use)
- Digital wallpaper or screensavers on personal devices
- Personal websites, blogs, or social media (non-commercial)
- Sharing with family and friends
Restrictions:
- No commercial use of any kind
- No use in advertising, marketing, products for sale, or business purposes
- No resale, redistribution, or inclusion in any product, template, or bundle for sale
- No modification for creating derivative works intended for resale

General Terms (Apply to Both Licenses)
Royalty-Free:
The license fee is paid once; no additional royalties are owed based on usage, provided such usage remains within the scope of the applicable license.
Model & Property Releases:
Where applicable, we make reasonable efforts to obtain model and/or property releases; however, we do not guarantee that releases exist for all images. Buyers are solely responsible for determining whether a release is required for their intended use and for obtaining any additional permissions necessary, particularly for uses involving identifiable individuals, private property, trademarks, or sensitive subject matter.
Attribution:
Not required, but appreciated where practical (e.g., “Photo by Michigan.Photography”).
Modifications:
You may crop, resize, color-correct, or otherwise adjust images as needed for your project. However, you may not claim ownership of the image or resell modified versions as stock photography or standalone files.
Prohibited Uses (for both licenses)
- Resale or redistribution of the image itself (alone or in collections)
- Use in templates, overlays, or digital products for resale
- Incorporation into AI training datasets, machine learning models, or generative tools, including dataset aggregation or similar technologies
- Any use that implies endorsement of a product, service, or organization without explicit written consent
- Defamatory, misleading, illegal, or pornographic uses
- Transfer, sublicense, resale, or assignment of the license or image to any third party, except as expressly permitted under the Commercial Use License for single-client work
Additional Provisions
Termination:
This license automatically terminates without notice if you breach any of these terms. Upon termination, you must immediately cease all use of the image and destroy or delete all copies in your possession or control. No refunds will be issued in the event of termination due to breach.
Warranties & Liability:
Images are provided “as is,” without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose. Michigan.Photography shall not be liable for any claims, damages, or losses arising from the use of the images beyond the original purchase price paid.
Governing Law:
This agreement is governed by the laws of the State of Michigan, USA, without regard to conflict of law principles. Any disputes arising under this agreement shall be resolved exclusively in the state or federal courts located within Michigan.
Updates to These Terms:
These terms apply to purchases made after the effective date of publication. Licenses purchased prior to any update remain governed by the terms in effect at the time of purchase.
